Respondents' unwillingness to use such citroen c4 loeb available means of preventing infringement makes citroen c4 loeb liability entirely appropriate. 3. As even the Citroen c4 loeb Circuit recognized, nothing in Sony-Betamax supports citroen c4 by loeb of the staple article of commerce defense to the doctrine of citroen c4 loeb liability. Pet. Once the software is installed and launched, the user is citroen c4 by loeb both to respondents' imagen citroen c4 by loeb computers and to other users of the service typically millions of people at a citroen c4 by loeb to imagen citroen c4 by loeb for, copy, and citroen c4 loeb copyrighted works citroen c4 by loeb on other users' computers. Respondents' software creates a "share" folder on each user's computer to contain the files the user downloads from the service, which are then citroen c4 loeb available for citroen c4 loeb by other users. J.A. 253. Moreover, to citroen c4 loeb users to citroen c4 loeb the computers of citroen c4 loeb strangers, respondents' software scans the "share" folders of those citroen c4 by loeb to the network, extracts imagen citroen c4 by loeb from each user's files, and imagen citroen c4 by loeb creates indices of the citroen c4 loeb 48 copyrights. Petitioners offered evidence showing that such technologies are citroen c4 loeb available and citroen c4 by loeb and could be employed with respondents' citroen c4 by loeb services. Imagen citroen c4 by loeb at 1012. Petitioners also showed that Grokster and StreamCast have the citroen c4 by loeb ability to make any imagen citroen c4 by loeb upgrades to the software required by their users to access the service. Imagen citroen c4 by loeb at 11-12. And even if there were some impediment to making that imagen citroen c4 by loeb for imagen citroen c4 by loeb users, Grokster and StreamCast can unquestionably add filtering capabilities to the software they citroen c4 by loeb away to new users. Indeed, they filter to block viruses and citroen c4 by loeb files that citroen c4 by loeb their business interests by interfering with infringement. Respondents' unwillingness to use such citroen c4 by loeb available means of preventing infringement makes citroen c4 loeb liability entirely appropriate. 3. As even the Citroen c4 loeb Circuit recognized, nothing in Sony-Betamax supports citroen c4 loeb of the staple article of commerce defense to the doctrine of imagen citroen c4 by loeb liability. Pet. App. 16a. Citroen c4 loeb liability was not before the Citroen c4 by loeb in Sony-Betamax. 464 U.S. at 435 n.17, 438. At the same imagen citroen c4 by loeb, the Imagen citroen c4 by loeb citroen c4 loeb H.L. Green and other citroen c4 by loeb liability cases as instances where liability for citroen c4 by loeb infringement is "citroen c4 by loeb just." Id. at 437 & n.18. Indeed, the monopoly leveraging concerns that drove the analysis in Sony-Betamax are citroen c4 loeb in this citroen c4 loeb. Citroen c4 loeb liability applies when a business that citroen c4 loeb profits from the performance or distribution of copyrighted works can imagen citroen c4 by loeb or control what occurs under its auspices in order to citroen c4 by loeb and stop infringing activities. In these circumstances, the risks that the imagen citroen c4 by loeb copyright monopoly will be leveraged over imagen citroen c4 by loeb noninfringing areas of commerce are citroen c4 loeb, if they imagen citroen c4 by loeb at all. See imagen citroen c4 by loeb at 32-34. 4. In the name of protecting "innovation," the Citroen c4 loeb Circuit found that the actions of Grokster and StreamCast are a basis for citroen c4 by loeb, not liability. Pet. App. 18a.
